Coordinated Legal Services
CDS maintains a legal team who are ready to assist our clients with all pre-foreclosure and post-foreclosure legal needs. This is a substantial benefit to our clients who can save the time and effort of having to search for qualified legal counsel outside of the foreclosure process. The legal services that we provide for our clients, include, but are not limited to the following:
Judicial Foreclosures
Based upon each individual client’s needs and goals, it is sometimes beneficial to pursue a judicial foreclosure, which under certain circumstances preserves the Lender’s right to seek a deficiency judgment against the debtor, and select which lien holders to include or exclude in the foreclosure process. We handle judicial foreclosures from inception, including the preparation and filing of the complaint and prosecution of the complaint through judgment.
Bankruptcy Matters
In the event that a debtor attempts to avoid or stall the foreclosure process, we can prepare and file in the Bankruptcy proceeding, a petition for relief from the automatic stay to allow our client(s) to proceed with the foreclosure process and get their money back.
Eviction/Unlawful Detainer Matters
In the event that our client(s) obtain title to the property after foreclosure, they need possession in order to market and sell the property or at a minimum make it a productive income producing asset. We handle all forms of commercial and residential eviction proceedings including service of all required notices, the filing of the unlawful detainer complaint, and prosecution of the complaint through judgment. We will obtain a writ of possession and lockout of the holdover party if necessary.
Real Estate Litigation and Transactional Matters
We offer legal services for all types of general contract and real estate litigation and transactions, including without limitation, any legal challenges brought by the debtor or any third party relating to the default or foreclosure process.
Judgment Collection Matters
We offer a wide array of collection mechanisms for our clients who have obtained
or hold a money judgment, including, without limitation, bank levies, wage garnishments, judgment debtor examinations, preparation and recordation of abstracts of judgment and asset investigation.
